Amsterdam, 19 September 2024 – Top officials at the Dutch Ministry of the Interior and Kingdom Relations have advised against the Cabinet’s intention to declare the current asylum situation a crisis to unilaterally implement emergency measures, according to recently released, heavily redacted documents.
The documents, shared with the Tweede Kamer, the lower house of Parliament, reveal that advisors believe there is no legal basis for such a declaration under the current circumstances. The revelation has sparked anger among opposition parties, who have criticized the extensive redactions, with GroenLinks-PvdA leader Frans Timmermans decrying the lack of transparency.
Prime Minister Dick Schoof has since agreed to provide unredacted versions of the documents to Parliament. The government’s proposed use of state emergency law to bypass established legislation and sidestep Parliamentary review has been deemed democratically and constitutionally unacceptable by the Interior Ministry advisors.
The documents, which were released under protest, were requested by parliamentarians who sought clarity on the Cabinet’s intent to implement emergency procedures for the reception of asylum seekers without Parliamentary oversight.
Officials from the Constitutional Affairs and Legislation Directorate emphasized that working outside of Parliament is only permissible in very urgent emergency situations, and they argue that the current situation does not meet this criterion. The Interior Ministry’s advisors maintain that the motivation for declaring a state of emergency is lacking and that the use of emergency powers is not justifiable under current circumstances.
The Ministry of Justice echoed these sentiments, expressing doubts about the legal viability of the proposed emergency measure and questioning whether there are exceptional circumstances that necessitate the activation of national emergency rules.
Civil servants also suggested an alternative approach, recommending that the emergency procedure be used to debate and vote on a law in both Houses of Parliament, rather than granting the Cabinet emergency powers.
The identity of the authors of these statements and the ministries they represent remain unknown due to the blacked-out sections of the documents. The advisors argue that developments that have been ongoing for years, without any unexpected major new developments, do not justify the use of emergency powers but rather necessitate ordinary policy changes.
The release of these documents has intensified the political debate surrounding asylum policy in the Netherlands, with opposition parties demanding greater transparency and adherence to democratic and constitutional principles.
