近日,上海市市场监管局执法总队与小红书、拼多多、携程、美腕、得物、美团、饿了么等17家互联网平台企业签订协作共治备忘录。此举旨在促进互联网平台企业健康、规范、高质量发展。

根据备忘录,执法总队将向平台企业提供违法违规典型案例、舆情信息处置等数据,以加强对平台企业的行政指导和提醒告诫。同时,企业需根据《电子商务法》《网络交易监督管理办法》《互联网广告管理办法》等相关规定,向总队提供治理数据、经营数据、消费投诉数据等,共享平台内经营者基础数据。

此外,监管部门以平台企业为“点”,相关违法交易行为为“线”,借助平台企业的大数据、云计算等技术手段,进一步提高监管、执法效能。为确保共治协作落地,17家平台企业共同担任协作共治机制的成员单位,其中5家企业作为理事单位,轮流担任常任理事。

Recently, the Enforcement Division of the Shanghai Market Supervision Bureau signed a cooperation memorandum with 17 internet platform companies including Xiaohongshu, Pinduoduo, Ctrip, Meipai, Dede, Meituan, and Eleme. This move aims to promote the healthy, standardized, and high-quality development of internet platform companies.

According to the memorandum, the Enforcement Division will provide internet platform companies with typical cases of illegal and regulatory violations, public opinion information disposal, and other data to strengthen administrative guidance and warning reminders for these companies. Meanwhile, companies are required to provide governance data, operating data, consumer complaint data, and share platform operator basic data with the bureau according to relevant regulations such as the “E-commerce Law”, “Measures for the Administration of Online Transactions”, and “Internet Advertising Management Method”.

In addition, regulators take platform enterprises as “points” and related illegal transaction behaviors as “lines,” leveraging the big data and cloud computing technologies of platform enterprises to further improve regulatory and law enforcement efficiency. To ensure the implementation of the cooperative memorandum, 17 internet platform companies jointly serve as members of the cooperative governance mechanism, with five companies serving as permanent members.
