Beijing Cracks Down on Professional Store Closers, Sending a Strong Signal Against ConsumerFraud
Beijing, China – In a landmark case, Beijing authorities haveannounced the first nationwide crackdown on professional store closers, individuals who exploit loopholes in business regulations to help failing businesses evade debts and leave consumers stranded. This crackdown, announced on October 22nd, sends a strong message against this growing form of consumer fraud.
The Beijing Municipal Administration for Market Regulation, in collaboration with theBeijing Municipal Public Security Bureau’s Economic Investigation Detachment, revealed details of the investigation into two companies, Art Umbrella and Wood Art, both art training institutions accused of engaging in professional store closure tactics.
The investigation uncovereda network of three intermediary companies, namely Beijing Chao Lai International Business Consulting Co., Ltd., Sichuan Shunli Jie Enterprise Management Consulting Service Co., Ltd., and Chuangqi Weilai (Beijing) Enterprise Management Consulting Co., Ltd., who played akey role in facilitating the closure of these institutions.
The modus operandi of these professional store closers involved recruiting individuals, known as debt bearers, to act as nominal legal representatives. These individuals would then submit fraudulent registration materials to relevant authorities, concealing crucial information. This allowed the failing businesses totransfer ownership to the debt bearers, effectively shielding the original owners from liability.
In the case of Art Umbrella, the professional store closers used this strategy to attract new customers with enticing discounts, only to shut down overnight and leave them with unpaid memberships.
The investigation resulted in the prosecution ofthe two companies and the three intermediary firms, as well as two individuals involved in the scheme. Fines and penalties totaling 655,800 yuan were imposed.
Experts believe this case sets a significant precedent. It serves as a strong deterrent to businesses and individuals involved in similar practices, highlighting the government’s commitmentto protecting consumer rights.
The crackdown on professional store closers comes at a time when incidents of pre-paid businesses, such as gyms and early education centers, suddenly closing down and leaving customers with unpaid memberships have become increasingly common.
This case underscores the need for stricter regulations and increased vigilance inidentifying and addressing fraudulent practices that exploit loopholes in the system. It serves as a warning to businesses and individuals to operate ethically and responsibly, ensuring the protection of consumer rights and fostering a fair and transparent business environment.
