News content:
Recently, the U.S. International Trade Commission (ITC) has submitted a lawsuit file to the U.S. Federal Circuit Court of Appeals, officially opposing the suspension of Apple’s proposed sales ban on the Apple Watch. Due to the patent dispute with medical technology company Masimo in the field of blood oxygen sensing, Apple suspended the sale of Apple Watch Series 9 and Apple Watch Ultra 2 in the United States in mid-December last year.

After that, Apple filed a motion for appeal and received a temporary suspension of the ban, allowing the company to resume sales in the United States. However, ITC attorneys stated in the lawsuit file that “Apple’s request to suspend the sales ban is weak and lacks persuasiveness. Apple’s argument is merely a controversial infringer asking to continue infringing on the patents it claims.”

Previously, Apple expected to resolve the patent dispute by the end of this month, either reaching an agreement with Masimo to withdraw the infringement lawsuit or obtaining U.S. customs approval for the submitted software update to bypass Masimo’s patents. Apple has already submitted a software update application to U.S. customs, attempting to use a backup means of software avoidance to resume sales of Apple Watch Series 9 and Apple Watch Ultra 2.

If Apple’s submitted software update can pass the customs investigation, the Apple Watch could be “freely sold without risk” as early as January 12. However, the ITC’s lawsuit file may once again pose a sales ban risk for Apple, making it crucial for the company to resolve this patent dispute.
